19 of the 20 states that are suing the federal government to repeal portions of the Affordable Care Act (ACA) are also applying for grant funding made available by the law. These states argue that the individual mandate to purchase health insurance is unconstitutional. However, ACA also authorizes a total of $1 million per state and the District of Columbia in grant funding for states to improve or develop insurer rate review processes or authorities. The states that have applied for the grant and that are in the process of challenging the law in federal court are Alabama, Arizona, Colorado, Florida, Idaho, Indiana, Michigan, Mississippi, Nebraska, Nevada, North Dakota, Pennsylvania, South Carolina, South Dakota, Texas, Utah, Virginia and Washington. Georgia and Alaska are challenging the law but to date have not applied for this grant.
